Chief Justice denies interim order against House dissolution, forwards case to constitutional bench

Kathmandu, December 23

The single bench of Chief Justice Cholendra Shamsher Rana has refused to issue an interim against the government’s decision to dissolve the House of Representatives.

The bench has forwarded all 12 writ petitions registered with the demand to the constitutional bench. Now, the bench comprising CJ Rana and four other justices will hear the case on Friday.

All of these petitions including one filed by some lawmakers of the ruling Nepal Communist Party have demanded the House reinstated. They also say the court should let the House operate until the final verdict.

During the hearing today, the petitioners argued the prime minister and the president do not have a right to dissolve the House unless it cannot elect the PM as per the constitution.
