Govt picks ‘Gyanendra Shah’s attorney’ for Judicial Council member

The government has recommended that senior advocate Laxmi Bahadur ‘Nirala’ Khadka be appointed as a member of the Judicial Council, the constitutional body that has rights over recruitment, transfer, and firing of justices and judges at all three levels of the judiciary.

Nirala was the attorney general of the country during the direct rule of King Gyanendra Shah before the 2006 People’s Movement. Therefore, his selection has surprised advocates close to the ruling Nepal Communist Party.

The position of a member is vacant at the council since the resignation of Padam Prasad Baidik earlier this month. Baidik had resigned with the hope of being nominated for a justice at the Supreme Court. Chief Justice Cholendra Shamsher Rana, who also heads the council, had reportedly assured him the position, but he had withdrawn after other members protested.

Nirala will be appointed to the council once the Parliamentary Hearing Special Committee endorses his name.
